Welcome to the AIUpscaler AI Creation Service (Hereinafter
referred to as "this service")! Here, you can generate creative
works in different styles using various AI creation tools. The
AI creation service provides users with technical services to
"generate images based on text, images, or a combination of text
and images." Users can upload images or enter different
descriptive texts, and the model will generate specific images
for them. This service includes but is not limited to AI art
fields such as painting, text, and video.
By using this service, you agree to this service agreement. If
you disagree with any part or all of the terms in this agreement
during your review, please stop using our services immediately.
This agreement is between AIUpscaler (i.e.AIUPSCALER.,
hereinafter referred to as "AIUpscaler" or "the platform") and
AI creation users (hereinafter referred to as "you"). It is
legally binding and applies to all activities you engage in
while using this service. These rules are an annex to the "Terms of Use" and the "Privacy Policy" and have the same legal effect. In the event of a conflict
between this annex and the "Terms of Use" and the "Privacy Policy", these rules shall prevail. For matters not mentioned in
these rules, the "Terms of Use" and "Privacy Policy" shall apply.
I. How We Use Your Personal Information
When you access the activity page and use this service, you may
be required to upload an image. We collect facial data solely
for the purpose of providing the AI Creation Service. The
uploaded image will be used exclusively to generate the result
you request and for no other purpose.
Your image is temporarily stored on our secure servers only for
the duration of the processing. It is permanently deleted once
the generation is complete or when you close the activity page.
AIUpscaler will use the content you provide only within the
reasonable, necessary, and clearly stated scope described in
this policy. Granting us permission to process your image does
not transfer ownership of your portrait rights and does not
affect your lawful rights to use your own image.
II. How We Protect Your Personal Information
We handle your personal information in full compliance with
applicable laws, regulations, and relevant confidentiality and
data protection standards.
We do not use your facial data to train any AI models, for
identification, marketing, or user profiling, nor do we share,
sell, or transfer it to any third parties.
All uploaded data is securely transmitted and deleted
immediately after use. AIUpscaler employs advanced security
measures to safeguard your information during processing,
preventing loss, misuse, unauthorized access, or disclosure.
III. Your rights
You guarantee that you have the legal rights to the content you
upload or have obtained the legal authorization from others and
have the right to use it for participating in this service.
Otherwise, you will bear all the consequences and losses caused
by this.
Except for the content you upload, all materials used in this
service that are provided by AIUpscaler are fully copyrighted by
the platform. The AI works you generate using the AI creation
service are limited to personal entertainment, learning,
research, or appreciation purposes and may not be used for any
commercial purposes.
IV. Prohibited Content
You agree not to upload, generate, or share any content that is
sexually explicit, pornographic, violent, hateful, or otherwise
inappropriate for public display.
NSFW (Not Safe For Work) content, including but not limited to
nudity, sexual acts, or sexually suggestive material, is
strictly prohibited.
AIUpscaler reserves the right to suspend or terminate access to
the service for users who violate this policy.
V. Disclaimers
You acknowledge and understand that all content generated by
this service is created by an artificial intelligence model.
AIUpscaler makes no guarantees regarding the accuracy,
completeness, or functionality of the generated content, and the
generated content does not represent the attitudes or views of
AIUpscaler. AIUpscaler's service is based on information
accumulated from sources allowed by laws and regulations,
including but not limited to publicly available internet
sources, and has undergone continuous automatic and manual
filtering of sensitive data. However, some information may still
have flaws, be unreasonable, or cause discomfort. If this
occurs, we welcome and thank you for reporting through the
contact information provided on this platform.
VI. How to update this agreement
Unless otherwise provided by these rules, AIUpscaler has the
right to change, interrupt, or terminate the activity page based
on business judgment. Unless otherwise provided by other rules
or documents, AIUpscaler does not bear any responsibility for
the corresponding changes, interruptions, or terminations.
